1. The controller of personal data is the company operating under the name Wecare sp. z o.o., with its registered office in Warsaw, address: Plac Konesera 8, 03-736 Warsaw, entered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000041335, NIP 5222551111, which processes users’ personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), the Act of 10 May 2018 on the protection of personal data, the Act of 18 July 2002 on the provision of services by electronic means, and the Telecommunications Law. Wecare sp. z o.o., as the owner and administrator of the website wecare.pl (the “Service”), presents below information regarding the application and use of personal data.
Wecare sp. z o.o. processes personal data: – for technical purposes, – in order to ensure the highest possible quality of the services provided.
Wecare sp. z o.o. ensures that all persons whose data it processes in any capacity are able to exercise the rights arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and other rights resulting from generally applicable provisions of law on the protection of personal data.

Disclosure of information
Wecare sp. z o.o. ensures that it does not disclose any data to unauthorised entities. Wecare sp. z o.o. makes users’ data available only to entities authorised under generally applicable provisions of law and on the basis of concluded agreements, in a manner not exceeding the scope of the consents granted by the user. Wecare sp. z o.o. discloses data to the following entities: a) entities providing hosting (storage) services for the Service and personal data for Wecare sp. z o.o., b) IT service providers and providers of marketing tools, including analytics tools,
Wecare sp. z o.o. reserves the right to send Service users information regarding the operation and functionality of the Service. Each Service user has the right to object to receiving the above information from Wecare sp. z o.o.
Any information which, within the meaning of the Act on the provision of services by electronic means, constitutes commercial information may be sent to users only with their consent, in accordance with Article 10 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2020, item 344, consolidated text) and Article 172 of the Act of 16 July 2004 – Telecommunications Law (Journal of Laws of 2021, item 576, consolidated text).
Personal data will not be transferred to third countries or international organisations.
§3.
Personal data
With regard to the protection of personal data, the User is entitled to all rights arising from the GDPR, in particular those indicated in item 5 below.
Where personal data are processed for the purposes of the controller’s own marketing, i.e., promoting the controller’s own goods and services, the personal data will be processed until the data subject requests their erasure. The legal basis for processing is Article 6(1)(f) GDPR.
Where a service is provided, the data will be processed for the period necessary to perform the agreement between Wecare sp. z o.o. and the User, as well as to fulfil obligations arising from provisions of law. The legal basis for processing is Article 6(1)(b) GDPR.
The Service User who has provided their personal data has the right to: a) access their data, rectify and erase them, subject to the proviso that the right to erasure applies where at least one of the criteria referred to in item 8 below is met, b) request restriction of the processing of their data due to their particular situation, c) lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, UODO), as well as d) where consent has been granted – withdraw that consent at any time; however, the withdrawal of consent previously given shall not affect the lawfulness of processing carried out before its withdrawal, e) data portability and to transfer their data to another controller. The data will be transferred to the controller indicated by the user in a commonly used format.
Providing personal data for marketing purposes is voluntary. Providing data for the performance of an agreement is also voluntary; however, failure to provide such data will prevent Wecare sp. z o.o. from entering into and performing the agreement.
Wecare sp. z o.o. collects and processes the following categories of personal data: a) First and last name b) Email address c) Telephone number
Pursuant to item 4 above, the User is entitled to the right referred to in Article 17 GDPR, i.e., the right to have their data erased (also known as the “right to be forgotten”). The User may exercise this right where at least one of the following criteria is met: a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, b) the data subject has withdrawn consent on which the processing is based and there is no other legal ground for the processing, c) the data subject objects, pursuant to Article 21(1) GDPR, to the processing and there are no overriding legitimate grounds for the processing, or the data subject objects, pursuant to Article 21(2) GDPR, to the processing, d) the personal data have been processed unlawfully, e) the personal data must be erased for compliance with a legal obligation under Union or Member State law to which the controller is subject, f) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1) GDPR.
§4.
Amendments to the Privacy Policy
Wecare sp. z o.o. reserves the right to introduce amendments to the Privacy Policy in the future, in particular where changes occur in generally applicable provisions of law on the protection of personal data.
With each change, a new version of the Privacy Policy will be published on the Service under the https://wecare.pl/privacy-policy/ tab.
By using the Service after an amendment to the Privacy Policy, the User accepts the changes in the new version of the Privacy Policy.
